InfoSAWIT, JAKARTA –Indonesia asked USA to re-consider the final decision about countervailing duty on biodiesel products of Indonesia to the Paman Sam itu.
Indonesia thought, it is overprotective decision. On 9 November 2017 lalu, United States Department of Commerce (USDOC) announced the final countervailing duty on biodiesel import products from Indonesia and Argentina.
USDOC published the countervailing duty between 34,45% - 64,73% for Indonesia. While Argentina gets 71,45% - 72,28%. “Indonesia asked for USA to re-consider the decision and should appreciate the good cooperation of both countries in free and fair trade. Indonesia would not be reluctant to sue USA through US Council or through Dispute Settlement Body WTO,” Secretary of Trade, Enggartiasto Lukita said in the official statement to InfoSAWIT, Saturday (19/11).
The final countervailing duty for Indonesia is lower than the temporary decision made by USDOC that had been publised in August 2017, reaching about 41,06% - 68,28%.
Knowing this, Indonesia thought, the decision of USDOC is too overprotective and disrecpected decision. Indonesia would struggle for it so that Indonesia would not be blamed for the subsidy accusation. United States International Trade Commission (USITC) now investigates it to know the loss of industries in USA because of imported biodiesel.
If USITC decides, there are losses, USDOC would instruct Customs and Border Protection in USA to continue the deposit according to the tax level decided. But if USITC told that there is no losses because of imported biodiesel, the investigation should stop. The final decision of USITC would be announced on 21 December 2017.
“If in the final decision, it is proved that the decision or methodology of calculation used by USA is not consistent with the regulation on WTO-Subsidy and Countervailing Measures Agreement, Indonesia would consider to evaluate every import of USA in Indonesia,” he said.
In 2016, biodiesel exports from Indonesia to USA reached USD 255,56 million. The numbers reached 89,19% of the total biodiesel exports to every country. But because of the accusation, the biodiesel exports from Indonesia to USA stop at all. (T2)
