InfoSAWIT, JAKARTA – On 13 March 2020 the President’s Regulation No. 44/ 2020 about the Sustainable Palm Oil Plantation Certification or Indonesian Sustainable Palm Oil (ISPO) was officially published and signed by President Joko Widodo. It was announced on 16 March 2020 by Minister of Law and Human Rights, Yasona H. Laoly, in the Document of Indonesian Republic No. 75 / 2020.
From what InfoSAWIT got, the regulation consists of 7 (seven) chapters and 30 (thirty) articles. Article 4, point 2 noted that the ISPO certification should be done by implementing the principles, such as, a. obedience to the regulations; b. the god plantation practices; c. the environmental cultivation, natural resources, and conservation; d. the responsibility to the employees; e. the social responsibility and the people’s economy empowerment; f. the transparency; and g. the sustainable business enhancement. Article 4 point 4 noted, the further regulation about the principles and criteria of ISPO as written in paragraph (2) and (3) would be regulated in the regulation of minister.
The interesting one from the President’s Regulation No. 44 / 2020 is that there would be sanction written in article 6, which is, the stakeholders who forbid the regulation in ISPO certification as written in article 5 would get the administration sanction by the minister.
In the regulation, the administrative sanction would be the written reprimand, fine, temporary discharge of palm oil plantation business, ISPO certificate freezing, and/or revocation of ISPO certificate. (T2)
