Labor Day: Reject Omnibus Law Cipta Kerja, Protect the Labor in Palm Oil Plantations

InfoSAWIT, JAKARTA – The government thought that the UU Ketenagakerjaan is not adaptive to what investors asked for. Based on that, the government designed the changes of UU Ketenagakerjaan through Omnibus Law Cipta Kerja which consists of 79 laws and 11 clusters. The government claimed that Omnibus Law Cipta Kerja has accommodated the interest of every side. But the government ignored the rejection of Omnibus Law from the labors unions and the civil organizations. In the recent days, the government claimed to postpone the clusters of labors in the Omnibus Law Cipta Kerja.

 

In the official statement to InfoSAWIT, Koalisi Buruh Sawit noticed that Omnibus Law Cipta Kerja would eliminate the certainty to work, certainty to get salary, certainty to get social and health protection. In palm oil plantation, the drafts of the regulation would be difficult for the labors because they could be as the freelancers, get contract, or no permanent status without numbers of money and social guarantee. Koalisi Buruh Sawit noted that the numbers of labors in palm oil plantations could be 20 million. Of the numbers, 60% are those in the vulnerable status work. This is one fact which describes the bad image of the labors situation in palm oil plantation and this would be legal in the Omnibus Law Cipta Kerja.

 

The palm oil labors should be paid based on their work result. Omnibus Law Cipta Kerja would legitimate the salary practice underneath the normal regulation. The contract system which would be legalized in the regulation would eliminate their rights to get social guarantee. Koalisi Buruh Sawit found that in many palm oil plantations many labors are not listed as the social guarantee participants by the companies. Koalisi Buruh Sawit claimed that Omnibus Law Cipta Kerja would not fulfill the labors needs on the work certainty, salary certainty, and the social and good living protection.

 

Koalisi Buruh Sawit noticed that if Omnibus Law Cipta Kerja would be officially published, it would legitimate the work practices which are equal to the force work. Kinds of work without certain status, payment based on the work result, the heavy burden of work, unreachable work result, the freelancers, no available social guarantee, and the intimidation to make union would run and be the right ones (to implement). The un-partisanship work policy would make the labors helpless.

 

Apart from the threat in Omnibus Law Cipta Kerja, the palm oil labors also face the threat of corona virus (Covid-19). It spreads to many sectors, including palm oil. The crude palm oil (CPO) exports from Indonesia to many countries, such as, China, ndia, European Union significantly decreased. It slows down the economy globally and threatens the labors namely in the upstream sectors. In the downstream sectors, it is afraid that there would be efficiency. The impact is clear that millions of labors in palm oil plantations in Indonesia would be unemployed. This, as same as the labors in other sectors, threatens them not to get the holiday allowance fully by saying that the companies are having hard times.

 

So far the palm oil plantation labors work as usual without the available supports from the company to minimize the spread of Covid-19. The freelancers are worse. They have to prepare their own maskers because the companies do not provide. The minimal self-protection tools make them vulnerable hit by the virus. The government minimally pays attention to them. The labors now face the threat to be unemployed and the virus. In this case, the government should publish the protection policy to the labors from the two. (T2)
