Environmental Law Expert: Presidential Regulation No. 5 of 2025 Could Resolve Land Conflicts

PALMOILMAGAZINE, JAKARTA – Environmental law expert Henry Subagyo emphasized the crucial role of a task force (Satgas) in implementing Presidential Regulation (Perpres) No. 5 of 2025. According to him, this task force must gather information from various sources, including the public, to ensure a more transparent and effective resolution of land conflicts.

“Relying solely on government data is not enough. Information should come from multiple sources, including communities and journalists, to provide a more comprehensive picture,” Henry stated during the launch of a peatland study report, a collaboration between Kaoem Telapak and Pantau Gambut, as reported by Palmoilmagazine.com on Tuesday (25/2/2025).

Henry pointed out that many land management reports have not been adequately addressed. He cited the Job Creation Law, which has been in effect since 2020 but continues to face implementation challenges. “There should be a more transparent oversight mechanism. Regulations must not remain mere documents without clear follow-through,” he stressed.

One of the main issues in land governance is the presence of companies controlling vast land areas but unable to manage them effectively due to ownership conflicts. “Many businesses are paying land taxes but cannot fully utilize their land because of disputes. A solution must be found,” Henry explained.

He urged the government to act as a mediator in resolving land conflicts, ensuring that the interests of communities, businesses, and environmental sustainability are balanced. “Disincentives should be applied to companies holding large land areas without productive use. This could encourage them to release idle land for better utilization,” he suggested.

Furthermore, Henry emphasized that the task force formed under Perpres 5/2025 must play a strategic role in facilitating dialogue and ensuring concrete solutions for tenure issues. “We cannot rely solely on regulations on paper. There must be real implementation involving all stakeholders,” he concluded. (P2)
