Duta Palma’s Lawsuit Rejected, Jakarta Administrative Court Confirms Agrinas as Legal Manager of State Assets

PALMOILMAGAZINE, JAKARTA — After a long and complex legal process, the Jakarta State Administrative Court (PTUN) has officially rejected the lawsuit filed by Duta Palma Group against several government institutions and PT Agrinas Palma Nusantara (Persero). This ruling reinforces Agrinas’s legal standing as the legitimate manager of state assets currently under legal seizure.

The verdict was delivered on Wednesday, July 2, 2025, in a virtual court session presided over by Chief Judge Oenoen Pratiwi, S.H., M.H.. The panel concluded that the State Administrative Court has no jurisdiction over the subject of the dispute.

According to Palmoilmagazine.com, citing Agrinas’s official website (Saturday, July 5, 2025), the court reasoned that the object of the lawsuit did not fall under administrative government actions, but rather judicial actions carried out by prosecutors. These include asset seizures executed as part of ongoing legal proceedings, and the handover of those assets to a third party—in this case, PT Agrinas Palma Nusantara (Persero)—accompanied by official documentation.

“While procedurally the handover may appear administrative, its substance is a continuation of lawful criminal investigation processes as stipulated in Indonesia’s Criminal Procedure Code (KUHAP),” the court stated in its legal considerations.

As previously reported, Agrinas was appointed by the government to temporarily manage assets seized in connection with legal cases involving Duta Palma Group. These assets were entrusted by the Attorney General’s Office and remain under legal proceedings. The temporary assignment is critical to prevent asset degradation, value depreciation, or excessive maintenance costs.

PT Agrinas Palma Nusantara (Persero) welcomed the court’s decision. Representing the company during the June 18, 2025, hearing, Brig. Gen. (Ret.) I Nyoman Suparta, S.H., M.H., Head of Legal Division, emphasized that all asset management activities have been conducted in full compliance with national laws and regulations.

This ruling also provides momentum for the broader transformation agenda of PT Agrinas Palma Nusantara, as it continues to build its position as a state-owned agribusiness entity with aspirations to become a national holding. Legal clarity regarding the assets under its management is a critical foundation for sustaining operations and achieving long-term strategic goals.
