PALMOILMAGAZINE, JAKARTA – The Supreme Court judges have rejected the plea for a case review involving PT Kaswari Unggul (PT KU) and the forest and land fire covering approximately 129.18 hectares in Jambi Province.
The decision, which was issued on October 30, 2023, upholds the previous rulings from the South Jakarta Court, DKI Jakarta High Court, and Supreme Court. PT KU has been ordered to pay Rp 25,527,525,180. This amount comprises Rp 15,758,610,630 in material losses and Rp 9,768,914,550 for environmental restoration.
The case started from the sue to Ministry of Environment and Forestry (MEF) in 2018 about the fire that took place in the concession areas of PT KU in 2015. The sentence of Supreme Court that reinforced the previous sentence, emphasized that MEF is committed to get law enforcement in environment sector. Judges in Supreme Court, such as, Chief Judge, Dr. Nurul Elmiyah, S.H., M.H.; Member Judges, such as, Dr. H. Haswandi, S.H., S.E., M.Hum., M.M., and Dr. Nani Indrawati, S.H., M.Hum., emphasized that PT KU should obey every sentence legally.

Meanwhile, Director of Environmental Dispute Resolution and Legal Consultant of Minister of Environment and Forestry, Jasmin Ragil Utomo told that the refusal of reappraisal by Supreme Court showed that MEF is really firm to every corporate that disobeyed industrial good governance in environmental management and fire case.
“MEF sued 22 companies and 13 of them have been legally sentenced. They are about to be executed,” Jasmin said, as in the official statement to Palmoilmagazine.com recently.

The sentence of Supreme Court in which the numbers are the same with the claim of MEF, emphasized that it needs to significantly get circumspection in environment management. MEF is ready to get execution process of the sentence after getting official document and copy of sentence of Supreme Court from DKI Jakarta High Court.
