SPKS Aceh Chairman Calls for Immediate Release of FPKMS Formulation Amid Lack of Agency Response

PALMOILMAGAZINE, ACEH – Abubakar AR, Chairman of the Serikat Petani Kelapa Sawit (SPKS) in Aceh Province and Regional Chairman of Fans Base Moeldoko in the same area, has called on heads of plantation and agriculture agencies across the province, regencies, and cities to promptly release the formulation for the “Fasilitas Pembangunan Kebun Masyarakat Sekitar” (FPKMS) around companies’ business rights.

He raised this concern due to the lack of response from many agencies regarding claims related to the mandates set by the General Directorate of Plantations at the Ministry of Agriculture.

He said the circulars published by General Directorate of Plantation were officially got by plantation agencies in the province, regencies, and cities of Aceh on 21 June 2024. But until now there is no real action for the public to know. “This is the order of regulations. There should be no aim that the people should not know it,” he firmly said to Palmoilmagazine.com, Thursday (15/8/2024).

In the Laws Number 39 / 2014 about Plantation, it regulates that every company or business should conduct FPKMS that reaches 20% from their business rights that the companies got from the country without exception both for the private companies, enterprises, and regional government. “The country regulates it in the laws. Would any ignore it?” he said.

He thought, the response from the agencies was too slow. In the circulars, it said that the company that had no areas should coordinate and get discussion with the local people. The other alternative is that it needs to develop livestock business or other activity on the areas that should minimally reach 20% of their business rights.

He continued the companies that got business rights should plant/develop the plantations in three years after getting the permits and develop the villagers’ plantations around the companies’ areas. “Everything is regulated. If any company ignores it, report it to plantation agency immediately so that it would be dealing with the central government,” he said.

Abubakar also reminded that every company that got business rights in Indonesia should obey the Regulation of Minister of Agriculture (RMA) Number 26 / 2007 and RMA Number 18 / 2021 about FPKMS. “We would monitor it. No game with the government’s mandate and smallholders in Indonesia,” he said.

For FPKMS in Aceh Province, he said, the deadline would be on 31 December 2024 as it is regulated in the circulars both for the regency and the companies. SPKS would report any fraud to Deputy II, President’s Staff Office, General Directorate of Plantation, and Ministry of Agrarian Affairs and Spatial/National Land Agency. They would be threatened by revoking the busiess rights if violating the regulations. If it is needed, he would take every case to the Supreme Court and Constitutional Court. (P2)
