The Areas of PT Bangun Jaya Alam Permai that the Villagers of Seruyan Clashed on

PALMOILMAGAZINE, PALANGKARAYA – In the recent days, there was clash in District of Seruyan, Central Kalimantan Provice between the villagers and police on 7 July 2023. Some villagers got hurt. The clash happened because PT Bangun Jaya Alam Permai (BJAP) did not realize its promise. The palm oil plantation company which is in affiliation with Best Agro International does not realize to develop plasma plantations for the villagers.

As the information managed from the report of Plantation Agency Central Kalimantan Province in 2022, PT BJAP developed plasma plantations that laid only 79,59 hectares (ha). The plantations are still immature. The numbers of width are far from the plasma development that the company should actually develop.

PT BJAP was PT Mitra Unggul Tama Perkasa in District of Seruyan. It got the location permit in 2006 that laid about 10.000 ha and 2007 that laid 13.500 ha. After few months later, in 2007 the company got Plantation Business Permit (PBP) for about 14.750 ha from two PBPs, they were, PBP Number 525/319/EK/2007 that laid about 13.500 ha and PBP Number 525/320/EK/2007 that laid about 1.250 ha.

Since 2008, PT BJAP just got PBP for about 1.240,41 ha on PBP Number 525/319/EK/2007. “It means, PT BJAP legally operates on 1.240,41 ha. PT BJAP illegally operate on 13.509,59 ha,” Executive Director of TuK Indonesia, Linda Rosalina said, as in the official statement to Palmoilmagazine.com recently.

The second, RMA Number 98 / 2013 as the substitution of RMA Number 26 / 2007, chapter 15, paragraph (1) which says, Plantation companies applying Plantation Business Permit for Cultivation or Plantation Business Permit with area of 250 hectares or more, should facilitate to develop plantations for villagers in the vicinity with the area of at least 20% of the total areas in Plantation Business Permit for Cultivation or Plantation Business Permit.

The third, the revision of Laws Number 39 / 2014 about Plantation, chapter 58 which says, Plantation companies that have Plantation Business Permit or Plantation Business Permit for Cultivation should facilitate to develop plantations for the villagers in minimum areas of 20% of the total plantations that the plantation company(ies) develops.

The other thing, Linda continued, is that she emphasized the government should seriously investigate that PT BJAP obey to pay property tax on the 14.750 hectares in District of Seruyan as it is regulated in the Regulation of Minister of Finance Number 186 / 2019. “If the government wants to optimize revenue from palm oil plantation sector, make sure the tax object and subject clearly.
